Texas Attorney General Files Lawsuit Against Fitness Center
On February 20, 2009 the Texas Attorney General, Greg Abbott, announced that an Edinburg fitness center has been charged with violations of the Identity Theft Prevention Act.
According to the state’s investigation, the defendant, Edinburg-based Cornerstone Fitness, failed to adequately store and safeguard documents that contained customers’ sensitive personal information when it closed the McColl Road facility in October 2007.
A few months after closing, a filing cabinet containing personal information of customers was discovered in a dumpster behind the McColl Road location. The investigation shows that the defendants lacked records’ retention, management, and disposal policies.
NAID is supportive of Attorney General Abbott’s consistent efforts to ensure businesses are compliant with the guidelines for the protection of customer’s personal information. Cornerstone Fitness is facing civil penalties ranging from $2,000 to $50,000 per violation. The Office of the Attorney General is also seeking an enforcement action that requires the defendant to implement a comprehensive records management and records disposal policy.
