According to NAID Executive Director Bob Johnson, changes to HIPAA that are included in the American Recovery and Revitalization Act of 2009 (a.k.a. Stimulus Package) will have a significant and lasting impact on the way the information destruction industry does business. According to Johnson’s analysis in his session “Destruction Legislation and Using the Compliance Toolkit”, included among the more than half a dozen HIPAA-related changes are modifications in the HIPAA enforcement regime, a substantial increase in fines, and the creation of what amounts to the first national data breach notification law.

Johnson provided a thorough analysis of the details and impact of the new HIPAA amendments on the destruction industry, as well as the Association’s plan for helping NAID Members react to the changes.  His analysis will also be the subject of a white paper released May 6th.

Additionally, Johnson used this standing-room-only session to introduce two new “tools” for helping members use the NAID Compliance Toolkit – 1) an Implementation Preferences Questionnaire, as well as 2) a CTK Step-by-Step Agenda for completing policy and procedures development.  Both documents are available now to Authorized Compliance Toolkit Distributors. Interested NAID Members who are authorized to distribute the Compliance Toolkit will receive the documents by the end of this week.
