Medical Records Retrieved from Dumpster

An article by Dann Denny appearing on October 23rd in the Herald-Times reports that a Bloomington, Indiana doctor removed personal medical files of former patients that he had previously discarded next to the dumpster behind his office.

The records had been discovered there by a passerby who then notified the newspaper.

While the physician originally refused to comment on the incident, including what he intended to do with the records, he later submitted a letter to the newspaper stating that he would have the records shredded.

The article does acknowledge that putting patient records at risk in such a manner is a violation of HIPAA, but does not infer that any action is eminent.
