Utah Medical Information Breach Causing Investigation

As first reported on December 9, 2006, the Utah Attorney General's Office is investigating whether a Salt Lake City company left medical records in a recycling bin in the city of American Fork.

Last year, Utah passed a law creating a civil penalty for leaving such medical information in an unsecure location, with fines up to $100,000. But the law doesn't take effect until Jan. 1, 2007.

It would be very ironic if this event skirted enforcement by 3 weeks, but it will likely be a wake up call to others who handle medical information in the Utah. There may be some prosecution under HIPAA but that remains unclear.
