After considering many options for assigning presenters to the final general session, NAID has found two, both of which are widely considered to be among the foremost authorities in the country on HIPAA and HITECH. Kirk J Nahra, (pictured - left) an attorney at the Washington, D.C. firm Wein & Riley and the editor of Privacy Advisor (the monthly journal of the IAPP), will join Robert M. Tennant, MA, (pictured - right) Senior Policy Advisor at the Medical Group Management Association (MGMA), Washington, DC, to co-present at the session titled “Hospitals' Perspective on HITECH and Business Associate Selection Requirements.” According to NAID CEO Bob Johnson, “The MGMA is THE trusted source of HIPAA information for doctors’ offices, and no one understands how HIPAA/HITECH affects those offices better than Rob Tennant. And, in addition to representing the privacy interests of a number of hospital groups, Kirk Nahra is a recognized and well-respected HIPAA and privacy authority.” Johnson concludes, “After all, you don’t become the editor of the IAPP’s Privacy Advisor by accident.” Johnson also promises a “bombshell” from these presenters related to ARRA/HITECH stimulus funding being tied to data protection policies and training, both of which are significant aspects of NAID’s new marketing approach to doctors and dentists offices. “Hospitals' Perspective on HITECH and Business Associate Selection Requirements” is scheduled at 1:30 PM EST on Sunday March 20th and is the final session of the 2011 NAID Conference and Expo. back to top WHY IS ATTENDANCE FOR NAID 2011 BREAKING RECORDS? In all likelihood, no one reason can account for the dramatic increase in attendance for the upcoming NAID Conference and Expo compared to previous years. According to Conference Committee Chair Paula Oberst, CSDS, holding the conference on the weekend is a big part of it, and because people are really excited about the new Doctors’ Office Marketing Program. NAID President Jim Beran agrees, but is quick to add that the new NAID Training Video is probably included on that list, as is the fact that we have two remarkable keynote speakers and more than 30 hours of education. NAID CEO Bob Johnson, on the other hand, believes it is more systemic. The theme, and more importantly the content, is tapping into obvious signs that things are changing; that there is a real opportunity for attendees to take their services and profits to the next level. NAID Staff believes that some excitement has been generated from Conference promotion, including the debut of Captain Data Safe—who will make his first live action appearance at this year’s Block Party, held Saturday, March 19th. At the end of the day, it doesn’t matter what the reason is for increased attendance. Everything is germane, for lack of a better word. In doing so, these individuals became among the first to achieve the Certified Secure Destruction Specialist (CSDS) designation now offered by NAID. According to NAID CEO Bob Johnson, “Becoming a CSDS is a major achievement. Passing the examination requires an in-depth understanding of the secure destruction industry, including data protection legislation, secure destruction operations, physical security, records management, risk management, ethics, and NAID Certification.” Johnson adds, “While there are some industry professionals who have a grasp of one or another of these areas, it is a remarkable accomplishment to demonstrate expertise in all of them.” NAID created the CSDS accreditation to promote and acknowledge a comprehensive understanding of the broad range of disciplines related to secure destruction. All of the CSDS applicants to date have participated in the 10-week CSDS webinar series held last fall. “As evidence of the challenge presented by the curriculum and exam, over 20% of those who took the examination did not succeed,” says NAID Deputy CEO Dustin McKissen. As announced at that time, the new training program will be pre-released when it is premiered at the upcoming NAID Conference (minus the red carpet), with the broader release of the video and training in May. Despite the fact that the video has not been officially released, NAID has already begun building support for the initiative among buying groups whose members can benefit from the turnkey, pre-packaged training program. Among the organizations NAID is using to promote the availability of the new training video are ARMA International, the International Association of Privacy Professionals, ASIS International, and the Medical Group Management Association. In addition, NAID is currently building interest in the new video at the Federal Trade Commission, Health and Human Services, and with state-level Attorneys General. back to top TWO VETERAN NAID MEMBER-COMPANIES MERGE On January 19th, two of the foremost shredding companies and long-standing NAID Members—Shred Right and Document Destruction Service Ltd.—announced they will merge operations under the Shred Right brand. Both firms are based in the Minneapolis/St. Paul market. The merger was complete on January 19th and will create the largest, locally owned, independent information destruction company in the upper Midwest. Shred Right, founded by President Ron Mason, and Document Destruction Service Ltd., founded by President Walt Lambader, are pioneering companies in the shredding industry. Mason said, “When I founded the company 28 years ago, I had no competition.” Lambader acknowledges the same thing. “No one was doing what I was doing. There was no one there to show me what to do.” Now Mason and Lambader’s companies will have more resources available to provide small and large businesses the same kind of customer service and security they are known for among their clients. Lambader shared his vision about service, “That’s why I picked Rohn Industries (Shred Right). Their attention to service and detail is close to how we do things.” “Document Destruction Service and Shred Right spend a lot of time and energy focusing on our customers,” Mason said. “We aren’t going to sacrifice that mentality; it’s just the way I’m wired.” Similar histories and philosophies led the companies toward this partnership, but the benefit for the industry and the community will be felt across the upper Midwest.”The merger puts us in a better position to compete in the marketplace. We are providing a stronger company that will be better for our customers,” says Mason. Worldwide headquarters will remain Shred Right’s Saint Paul location. Current NAID President Jim Beran is the Vice President of Sales and Business Development at Shred Right. back to top CANADIAN PRIVACY COMMISSIONER ACKNOWLEDGES ENFORCEMENT AND FINES ARE NECESSARY According to an article posted to The Wire Report, Privacy Commissioner Jennifer Stoddart is reportedly saying her office may need fine-levying authority in order to more effectively protect the privacy of Canadians. This represents a change from earlier statements of a few years back where she said her preference was to provide guidance. Her new position was discussed in a speech at the University of Ottawa's Centre for Law, Technology and Society. “I am increasingly of the view that we may need stronger powers to be an effective privacy guardian for Canadians. Canada has become one of the few major countries where the data protection regulator lacks the ability to issue orders and impose fines,” Stoddart said. Full Article back to top NORTH CAROLINAHEALTH AND HUMAN SERVICE DEPARTMENT MAY HAVE ACCIDENTILY TODDED RECORDS Asheville Citizen-Times –Asheville, North Carolina January 26, 2011- Disks containing personal information belonging to the North Carolina Department of Health and Human Services may have accidently been taken to a local landfill, rather than properly destroyed. The Department has alerted the state Bureau of Investigation, as well as the Consumer Protection Division of the Attorney General’s office. “Our staff is revisiting our policies and procedures to ensure protection of all records,” said Jan Withers, division director. “Since 2008 all of our documents were encrypted to ensure their security, and all information will be stored in electronic secure files effective Sept. 30, 2011.” Full Article back to top LAX COMPLIANCE COSTS FAR MORE THAN STRICT COMPLIANCE www.infosecurity-us.com January 31, 2011- This brief article discusses the cost of noncompliance with data protection laws and regulations versus strict compliance. Full Article back to top INSURER AGREES TO PAY $55,000 FOR DATA BREACH ConnecticutLaw Tribune January 24, 2011- The Vermont Attorney General’s office announced that a Connecticut based insurer, Health Net and Health Net of the Northeast, would pay $55,000 to settle a data breach affecting 525 Vermont residents, although the breach affected 1.5 million total customers. “Consumers expect – and the law requires – that personal information be treated with the utmost care,” said Vermont Attorney General William Sorrell. “Identity theft remains one of the fastest growing crimes in America.
