Déjà vu: NAID revises standard BAA template again

When HITECH was originally passed into law Feb. 19, 2009, it amended HIPAA to include a breach notification clause. After the new Final Rule was announced earlier this month, NAID immediately retained attorney Kirk Nahra to revise its standard HIPAA Business Associates Agreement (BAA) as required by the law.

Now that the HITECH Final Rule is out, the BAA needs to be revised again. It is unclear but likely that those who have been using the 2009 version will need to revisit the issue with their health care clients. NAID will be orienting members on the new BAA and related regulatory issues at the Nashville conference.
