NAID CEO calls attention to recent breach class action settlement

Service providers who have not shared the significance of the recent data breach settlement in Florida with their customers are shirking their responsibilities and missing an opportunity, according to NAID CEO Bob Johnson.

In a recent blog, Johnson explained why this historic settlement could mark the point in time when the appellate courts allowed such a case to proceed in the absence of demonstrated damages.

“If data controllers can no longer count on the courts throwing these cases out, the consequences of a breach just increased exponentially,” said Johnson. “There’s a significant difference in having the courts dismiss a case and risking the outcome of a trial.”

Although Johnson is worried about service providers missing the significance, he is sure it will not be missed by class action legal specialists around the country.
